Currency Conversion

Misuse of Website
The site is for the sole purpose of allowing our customers to determine the availability of goods and services offered on the Site and to make legitimate reservations (directly or through a third-party supplier) or otherwise transact business with CARIBBEAN AIRLINES, and for no other purposes. You agree that you will not use the Site for any commercial purpose and only to make legitimate reservations or purchases for you or for another person for whom you are authorized to act both legally and under the terms of this Agreement. You agree not to make any false or multiple reservations and to abide by the terms and conditions of purchase and carriage. 

Your account information is owned by and proprietary to CARIBBEAN AIRLINES. You agree to access your account information through the Site and to not give access to your account to any person or entity other than a member of your household or a person that you directly supervise as part of your career or employment.

You agree not to misuse the sites. Any use of the site for any purpose other than the purposes outlined above will constitute “misuse”.
Indemnification for use of Website
You agree to be responsible to and to indemnify, defend, and hold harmless CARIBBEAN AIRLINES and its affiliates from and against any and all claims, demands, proceedings, suits and actions, including any related liabilities, obligations, losses, damages, deficiencies, penalties, taxes, levies, fines, judgments, settlements, expenses based on, arising out of or resulting from your use of the Site and for breach of any agreements set out in this notice whatsoever.
Notice of Incorporated Terms
This notice forms part of the conditions of contract between the airline and the passenger. If there is any inconsistency between the incorporated items described below and the terms and conditions in the passenger’s ticket, these incorporated terms govern. Foreign air transportation is governed by applicable tariffs on the file with the United States, the United Kingdom and other Governments. Incorporated terms may include, but are not restricted to:
  1. Limits on liability for personal injury or death.
  2. Limits on liability for baggage, including fragile or perishable goods and availability of excess valuation coverage.
  3. Claims restrictions, including time periods in which passengers must file a claim or bring an action against the air carrier.
  4. Rights of the air carrier to change terms of the contract.
  5. Rules on reconfirmation of reservations, check-in times, and refusal to carry.
  6. Rights of the air carrier and limits on liability for delay or failure to perform service, including schedule changes, substitution of alternate air carriers or aircraft and rerouting.
You can obtain additional information on items 1 through 6 above at any location where the transporting air carrier’s tickets are sold. You have the right to inspect the full text of each transporting air carrier’s conditions of carriage at its airport and city ticket offices. You also have the right, upon request, to receive free of charge the full text of the applicable conditions of carriage incorporated by reference from each of the transporting air carriers. Information on ordering the full text of each air carrier’s conditions of carriage is available at any location where the air carrier’s tickets are sold.
Notice/Conditions of Contract
  1. As used in this contract "ticket" means this passenger ticket and baggage check, of which these conditions and notices form part, "carriage" is equivalent to "transportation," "carrier" means all air carriers that carry or undertake to carry the passenger or his baggage hereunder or perform any other service incidental to such air carriage, "WARSAW CONVENTION" means the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw, 12th October 1929, or that Convention as amended at The Hague, 28th September 1955, whichever may be applicable. “MONTREAL CONVENTION” means the Convention for the Unification of Certain Rules Relating to International Carriage by Air done at Montreal on May 28, 1999.
  2. Carriage hereunder is subject to the rules and limitations relating to liability established by the Warsaw Convention as it relates to travel governed by the Warsaw Convention or the Montreal Convention as it relates to travel governed by the Warsaw Convention, unless such carriage is not "international carriage" as defined by those Conventions.
  3. To the extent not in conflict with the foregoing carriage and other services performed by each carrier are subject to: (i) provisions contained in a ticket; (ii) applicable tariffs; (iii) carrier's condition of carriage and related regulations which are made part hereof (and are available on application at the offices of the carrier) except in transportation between a place and the United States or Canada and any place outside thereof to which tariffs in force in those countries apply.
  4. Carrier's name may be abbreviated in the ticket, the full name and its abbreviation being set forth in carrier's tariffs, conditions of carriage, regulations or timetables. Carrier's address shall be the airport of departure shown opposite the first abbreviation of the carrier’s name in the ticket. The agreed stopping places are those places set forth in the ticket or as shown in the carrier’s timetables as scheduled stopping places on the passenger’s route. Carriage to be performed hereunder by several successive carriers is regarded as a single operation.
  5. An air carrier issuing a ticket for carriage over the lines of another air carrier does so only as its agent.
  6. Any exclusion or limitation of liability of carrier shall apply to and be for the benefit of agents, servants and representatives of carrier and any entity whose aircraft is used by carrier for carriage and that entity’s agents, servants and representatives.
  7. Checked baggage will be delivered to bearer of the baggage check. In case of damage to baggage moving in international transportation complaint must be made in writing to carrier forthwith after discovery of damage and, at the latest, within 7 days from receipt. In case of delay, complaint must be made within 21 days from date the baggage was delivered. [See tariffs or conditions of carriage regarding non-international transportation.]
  8. The ticket is good for carriage one year from date of issue, except if otherwise provided in the ticket, in carrier’s tariffs, conditions of carriage, or related regulations. The fare for carriage is subject to change prior to commencement of carriage. Carrier may refuse transportation if the applicable fare has not yet been paid.
  9. Carrier undertakes to use its best efforts to carry the passenger and baggage with reasonable dispatch. Times shown in timetable or elsewhere are not guaranteed and form no part of the contract. Carrier may without notice substitute alternate carriers or aircraft, and may alter or omit stopping places shown on the ticket in case of necessity. Schedules are subject to change without prior notice. Except as stated in the Conditions of Carriage, carrier assumes no responsibility for making connections. For damage occasioned by delay to your journey, 4694 Special Drawing Rights (approximately EUR5539; $US7036) per passenger in most cases.
  10. Passenger shall comply with government travel requirements, present exit and entry and other required documents and arrive at airport by time fixed by carrier or, if no time is fixed, early enough to complete departure procedures.
  11. No agent, servant or representative of carrier has authority to alter, modify or waive any provision of the contract unless authorised by a corporate officer of carrier.
Notice of Overbooking of Flights
Airline flights may be overbooked, and there is a slight chance that a seat will not be available on a flight for which a person has a confirmed reservation. If the flight is overbooked, no one will be denied a seat until airline personnel first ask for volunteers willing to give up their reservation in exchange for a payment of the airline’s choosing. If there are not enough volunteers the airline will deny boarding to other persons in accordance with its particular boarding priority. With few exceptions, persons denied boarding involuntarily are entitled to compensation. To be eligible for compensation, customers must have presented themselves at the airport for check-in at least two (2) hour before departure of the international flight. Check-in means face-to-face interaction with an airline representative at the check-in counter. 
Advice to Passengers on Limitation of Liability

Passengers on a journey involving an ultimate destination or a stop in a country other that the country of origin are advised that the provisions of the Warsaw Convention or the Montreal Convention as appropriate may be applicable to the entire journey, including any portion entirely within the country of origin or destination. For such passengers on a journey to, from, or with an agreed stopping place in the United states of America, the Convention and special contracts of carriage embodied in applicable tariffs provide that the liability of CARIBBEAN AIRLINES and certain other carriers party to such special contract; for death of or personal injury to passengers is limited in most cases to proven damages not to exceed US$75,000 per passenger where travel is governed by the Warsaw Convention and US$166,838 where travel is governed by the Montreal Convention*, and that this liability up to such limit shall not depend on negligence on the part of the Carrier. For passengers traveling by a Carrier not a party to such special contracts or on a journey not to, from, or having an agreed stopping place in the United States of America, liability of the Carrier for death or personal injury to passengers is limited in most cases to approximately US$10,000 or US$20,000. The names of Carriers party to such special contracts are available at all ticket offices of Carriers and may be examined on request. Additional protection can usually be obtained by purchasing insurance from a private company. Such insurance is not affected by limitation of the Carrier’s liability under the Conventions or such special contract of carriage. For further information please consult your airline or insurance company representative.

*Note: The limit of liability of US$75,000 or SDR113100 (approximately US$166838) above is not inclusive of legal fees and costs except that in the case of a claim brought in a State where provision is made for separate award of legal fees and costs, the limit shall be the sum of US$58,000 exclusive of legal fees and costs.

Notice of EC Regulations 2027/97
CARIBBEAN AIRLINES is not subject to and does not apply the liability provisions of European Community Regulation 2027/97 which requires European Community air carriers not to apply any financial limit to their liability to passengers for death or injury, and to make prompt advance payments in the event of hardship following an accident. CARIBBEAN AIRLINES is subject to and applies the liability provisions of the Warsaw Convention or the Montreal Convention, as applicable.

Restricted Articles

It is illegal to carry dangerous goods – that means anything that poses a significant threat to health, safety or property when transported by air – in your checked baggage or hand baggage. Dangerous goods include explosives (flares, fireworks, ammunition, certain chemicals, power rivets, etc); gases (aerosols containing toxic, flammable and/or explosive substances, butane cylinders, breathing apparatus); flammable liquids and materials (paints, lacquers, polish, filters, adhesives, lighter fluids, matches); household cleaners (bleaches, ammonia, corrosive substances, items such as car and wheelchair batteries); pesticides and other toxic substances; swimming pool chemicals and other oxidizing substances; and magnetized materials. Read the warning labels on items before packing your bags, and check with CARIBBEAN AIRLINES’s Cargo Division if you wish to transport any dangerous goods as cargo. Transport of explosives or munitions of war as cargo requires the approval of the Ministry of Works and Transport in Trinidad and Tobago.

Baggage Liability,Tips And Information
Baggage Liability:
Baggage liability is covered under the Warsaw Convention or the Montreal Convention depending on the route of travel. For travel governed by the Warsaw Convention, we will reimburse up to US$9.07 per pound, up to a maximum weight of 70 pounds per checked bag (a maximum of US$634.90 per checked bag). Baggage covered under the Montreal Convention is reimbursed at the maximum value of 1131 SDR’s (approximately US$1800) per ticketed customer.

Caribbean Airlines does not accept in or as checked baggage fragile, perishable or valuable articles inclusing without limitation money, jewellery, eye wear, negotiable paper, securities, documents/certificates (business, medical, travel, education), samples, paintings, antiques, artifacts, manuscripts, irreplaceable books or publications, medication, keys, cameras and other photgraphic or movie equipment, working papers ( files, studies, reference material,correspondence, theses etc.), or electronic equipment(videos, stereos, computers). These items should not be placed in checked baggage but can be taken onboard ( subject to carry-on baggage restrictions).

Except as may be required by the Montreal Convention or Warsaw Convention, where applicable, Caribbean Airlines will not accept liability for fragile, perishable or valuable articles including without limitation the following:

Loss of protruding parts such as wheels, pull-straps, pockets, handles nor for damage such as nicks, scratches, scuff marks, dents, cuts, soils; damage to wheels, handles, pockets, locks, zippers, pull straps or for damage due to over packing and manufacturer’s defects.

Damage or loss to electronic devices including camera equipment, cash and jewelry, medication, business documents in checked or un-checked luggage

Damage arising from our compliance with applicable laws or government rules and regulations or from your failure to comply with same.

We recommend that you; (i) lock your baggage, (ii) place your name, address and contact details on the inside and outside of your baggage; and (ii) carry electronic devices and camera equipment, cash, jewelry and other like valuables and medication and prescriptions with you on the aircraft.

We strongly recommend that you obtain adequate travel insurance cover prior to your journey.
